1. About these terms
These Terms and Conditions govern your use of prashantkumarpandey.com and any services you buy from Digital Prashant ("we", "us"). By using the website or signing up for a plan, you agree to them.
2. Services
We provide digital marketing services including SEO, AEO/GEO, social media management, content, paid advertising management, websites, branding and automation, as described on our Services page and in your proposal. The written proposal or invoice you accept defines the exact scope.
3. Fees, GST and payment
- Plan prices are in Indian Rupees and exclude 18% GST.
- Monthly plans are billed in advance at the start of each billing month. Yearly plans are billed in advance for 12 months.
- One-time projects require 50% advance and 50% before final delivery or go-live.
- Invoices are due within 7 days. Work may pause if payment is overdue.
4. Advertising spend
Ad spend on Meta, Google or other platforms is not included in plan fees. It is paid by you directly to the platform. We do not guarantee platform approval of ads or accounts, which is decided by the platform.
5. Cancellation and refunds
- Monthly plans can be cancelled with 15 days' written notice before the next billing date.
- Yearly plans carry a 12-month commitment in return for the discount.
- Fees for work already started or delivered are non-refundable. Unused, unstarted one-time project work may be refunded at our discretion.
6. Your responsibilities
You agree to provide accurate information, timely approvals and access to the accounts we need. You confirm that any content, logos or images you give us are yours to use. Delays in approvals may delay deliverables.
7. Ownership
Once fully paid, you own the final creatives, content and website delivered for you. Your ad accounts, social pages and domains always remain in your name. We may show non-confidential work in our portfolio unless you ask us not to.
8. Results
Marketing results depend on many factors outside our control, including competition, platform algorithms, budgets and your product and sales process. We commit to best effort and transparent reporting, not to specific rankings, leads or revenue.
9. Limitation of liability
To the extent permitted by law, our total liability for any claim is limited to the fees you paid us in the 3 months before the claim. We are not liable for indirect or consequential losses.
10. Confidentiality
Both parties keep each other's non-public business information confidential, during and after the engagement.
11. Governing law
These terms are governed by the laws of India. Courts in Gurugram, Haryana have exclusive jurisdiction.
